These terms are an agreement between you and Karmastudio LLC, a US limited liability company ("we", "us"), for the use of Openlead at openlead.ai (the "service"). By creating an account or using the service you accept them. If you accept them for a company, you confirm you may bind that company.
The service
Openlead finds companies that match the customer you describe, and people at those companies, from public web sources. Results are stored in your workspace, can be saved to lists and exported. The service is for businesses, not consumers.
Accounts
You need an account to use the service. Sign-in works with a code or link we email you, so your account is as secure as your inbox: keep that inbox protected. Give us a working email address and keep it current. You are responsible for what happens in your workspaces, including what invited team members do. Seats and workspaces are limited by your plan.
Acceptable use
The lead data Openlead gives you is business contact data. You may use it only lawfully:
- You are responsible for your own outreach. Complying with the laws that apply to it, including CAN-SPAM, the GDPR, the ePrivacy rules and their local equivalents, is your job, not ours. Where the law requires consent, an existing relationship or an opt-out mechanism, you provide it.
- Do not resell, sublicense, publish or redistribute lead data. It is for your own prospecting, inside your own organization.
- Do not scrape, crawl or bulk-download the service, probe it for weaknesses, or use it to build a competing database.
- Do not share accounts, work around plan limits, or use the service for anything unlawful, deceptive or harmful.
We may suspend or close accounts that break these rules.
Plans, billing and renewal
Paid plans are billed through Stripe, monthly or yearly, and renew automatically at the end of each period until cancelled. You can cancel any time through the billing portal, reached from your billing page; the cancellation takes effect at the end of the paid period, and there is no refund for the remainder. Credit packs are one-time purchases and expire 12 months after purchase.
We may change prices. A price change applies to your plan at the earliest on its next renewal, and we tell you before it does. Refunds beyond what the law requires are at our discretion.
Taxes are on top where they apply.
Your data and our data
What you put into the service (your searches, lists, workspace details) stays yours. You give us the rights needed to run the service on it. The lead database, the software and the site are ours or our licensors'; these terms give you no rights in them beyond using the service. If you send us feedback, we may use it without obligation.
How we handle personal data is described in the privacy policy.
Data accuracy
Lead data comes from public web sources and is provided as is. We do not promise it is accurate, complete or current. People change jobs, companies change names. Verify before you rely on it, and expect some records to be wrong.
Termination
You can stop using the service and delete your account at any time. We can suspend or terminate your access if you materially break these terms, if the law requires it, or if we shut the service down; in the last case we tell you with reasonable notice. On termination your right to use the service ends. Sections that by their nature survive (acceptable use, disclaimers, liability, indemnity) survive.
Warranty disclaimer
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service is uninterrupted, error-free or secure.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims in any 12 months is limited to the amount you paid us for the service in those 12 months. Nothing in these terms limits liability that the law does not allow to be limited.
Indemnity
You will defend and indemnify us against claims arising from your use of the service in breach of these terms, including claims arising from your outreach to people in the lead data.
Changes to these terms
We may change these terms. If a change is material, we tell account holders by email before it takes effect. Using the service after the change takes effect means you accept it.
Governing law
These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of laws rules. Disputes belong to the state and federal courts located in Wyoming, and both sides consent to their jurisdiction.
